Non-preference category: The category of immigrant visas available to qualified applicants who are not eligible for a visa under the pre-Immigration Act 1990 preferential system. It is important to understand that just because migrants do not flee persecution does not mean they always have the right to have all their human rights protected and respected, regardless of their status in the country where they have settled. Governments must protect all migrants from racist and xenophobic violence, exploitation and forced labour. Migrants should never be detained or forced to return to their countries without a legitimate reason. A motion to discontinue is a formal written request to a judge to order that certain evidence be excluded from consideration by the judge or jury at trial. The term “suppression request” generally includes requests in criminal cases where the proposed basis for exclusion derives from the U.S. Constitution, a state constitution, or a specific statute that permits the exclusion of certain types of evidence (for example, a claim that police proceedings in a particular case violated the defendant`s right to be free from improper search and seizure). Parolee: A non-citizen who appears inadmissible to the inspector, who is allowed to enter the United States on urgent humanitarian grounds, or if it is determined that the non-citizen`s entry serves a significant public benefit. Probation is not a formal admission to the United States and confers only temporary status, which requires probation officers to leave the country if the conditions of their parole no longer exist. Accompanied Minor – (AM): A child who does not have legal immigration status in the United States, is under the age of 18, and is traveling with a legally authorized adult. Adjustment of Status – LPR (ADJ): An alien who is already in the United States and becomes a lawful permanent resident (LPR) by applying for LPR status with the United States Citizenship and Immigration Services (USCIS) and obtaining approval of the application. Age: The number of complete years between a person`s date of birth and an event. Agency: an office or program component within a department; An independent government agency.
Serious Crimes: A category of offenses listed under 8 U.S.C. 1101(a)(43) that, when committed by a noncitizen who is later convicted of such crimes, prevent the noncitizen from receiving most forms of facilitation after the United States. immigration law or to be brought back to the United States at any time in the future. Agricultural Worker: A foreign national who comes to the United States temporarily to perform agricultural work or services, as defined by the Secretary of Labor. Alien: Terminology used in Title 8 of the United States Code to describe a person who is not a citizen or national of the United States.
